This privacy policy applies to all information collected through our website(s) and/or our mobile app (hereinafter collectively referred to as "R8 Services").
When you use the R8 Services, you are entrusting us with your personal data. We take your privacy very seriously. In this privacy policy, we try to explain to you as clearly as possible what information we collect, how we use it, and what rights you have regarding it. We hope you take some time to read it carefully, as it is important. If you do not agree with the terms of this privacy policy, please discontinue use of the R8 Services.
This privacy policy was written in German. In the event of a conflict between the German version and a translation of the privacy policy, the German version shall prevail.

Data Collection via R8 Services
How do we collect your data?
Your data is collected primarily by you communicating it to us. This may include data that you provide during registration, for example.
Other data is collected automatically when you visit the website through our IT systems. This is primarily technical data (e.g., internet browser, operating system, or time of page visit). This data is collected automatically as soon as you use the R8 Services.
During use of the mobile app, R8 receives basic information from the mobile device manufacturer. This includes, for example, the name of the mobile device used (e.g., iPhone 8) or the version of the operating system currently being used.
What do we use your data for?
Part of the data is collected to ensure error-free provision of the R8 Services. Other data may be used to analyze your user behavior.
What rights do you have regarding your data?
You have the right at any time to receive free information about the origin, recipients, and purpose of your stored personal data. You also have the right to request correction or deletion of this data. For this purpose, as well as for further questions on the subject of data protection, you can contact us at any time at the address provided in the imprint. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.
You also have the right to request restriction of the processing of your personal data under certain circumstances.
Analysis Tools and Third-Party Tools
When using the R8 Services, your browsing behavior may be statistically evaluated. This is mainly done with cookies and with so-called analysis programs. The analysis of your browsing behavior is usually anonymous; browsing behavior cannot be traced back to you.
You can object to this analysis or prevent it by not using certain tools.
2. HOSTING AND CONTENT DELIVERY NETWORKS (CDN)
2.1. External Hosting

The personal data collected on this website is stored on the host's servers. This may primarily include IP addresses, contact requests, meta and communication data, contract data, contact details, names, website accesses, and other data generated via a website.
The use of the host is for the purpose of contract fulfillment with our potential and existing customers (Art. 6 para. 1 lit. b GDPR) and in the interest of a secure, fast, and efficient provision of our online offering by a professional provider (Art. 6 para. 1 lit. f GDPR).
Our host will only process your data to the extent necessary to fulfill its performance obligations and will follow our instructions regarding this data.
2.2. Data Processing Agreement
To ensure data protection-compliant processing, we have concluded a data processing agreement with our host.
3. GENERAL INFORMATION AND MANDATORY INFORMATION
3.1. Data Protection
We take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.

3.3. Revocation of Your Consent to Data Processing
Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. An informal notification by email to us is sufficient. The legality of data processing carried out until the revocation remains unaffected by the revocation.
3.4. Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)
If data processing is based on Art. 6 para. 1 lit. e or f GDPR, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. 3.5. Right to Lodge a Complaint with the Competent Supervisory Authority
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or place of the alleged violation. The right to lodge a complaint is without prejudice to other administrative or judicial remedies.
3.6. Right to Data Portability
You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of data to another controller, this will only be done to the extent technically feasible.
3.7. SSL or TLS Encryption
The R8 Services use SSL or HTTPS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.
When SSL or HTTPS encryption is activated, the data you transmit to us cannot be read by third parties.
3.8. Information, Deletion, and Correction
Within the scope of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients, and the purpose of data processing and, if applicable, a right to correction or deletion of this data. 3.9. Right to Restriction of Processing
You have the right to request restriction of the processing of your personal data. For this purpose, you can contact us at any time at the address specified in Section 3.2. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request restriction of the processing of your personal data.
- If the processing of your personal data happened or is happening unlawfully, you can request restriction of data processing instead of deletion.
- If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request restriction of the processing of your personal data instead of deletion.
- If you have filed an objection pursuant to Art. 21 para. 1 GDPR, a balance must be made between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data - apart from its storage - may only be processed with your consent or for the assertion, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.
3.10. Objection to Advertising Emails
The use of contact data published within the scope of the imprint obligation to send advertising and information materials not expressly requested is hereby objected to. We expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam emails.
4. DATA COLLECTION
4.1. Registration
We offer users of the R8 Services the opportunity to register by providing personal data. The data is entered into an input mask and transmitted and stored by us. The data is not passed on to third parties. The following data is collected during the registration process:
- Email address
- Username
- Password
- Date and time of registration
During the registration process, the user's consent to process this data is obtained. The legal basis for processing the data is Art. 6 para. 1 lit. a GDPR if the user has given consent.
4.2. Current Location
Users of the R8 Services have the option to share their current location (longitude and latitude). Corresponding data, e.g., the location at the time of application or further use of the R8 Services, are only collected if the user gives their consent.
4.3. Search History
During use of the R8 Services, it is recorded what terms users search for, e.g., names of movies, series, or actors and actresses.
4.4. Cookies
The R8 website uses so-called "cookies". Cookies are small text files and do not cause any damage to your device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your device until you delete them yourself or automatic deletion is performed by your web browser.
Cookies from third-party companies may also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g., cookies for processing payment services).
Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies serve to evaluate user behavior or display advertising.

When deactivating cookies, the functionality of this website may be limited.

4.5. Server Log Files
The provider of the R8 website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

- Operating system used
- Referrer URL hostname of the accessing computer
- Time of the server request
- IP address
This data is not merged with other data sources. Data collection is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website - for this purpose, server log files must be recorded.
4.6. Inquiry by Email
If you contact us by email, your inquiry including all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.
This data is processed on the basis of Art. 6 para. 1 lit. b GDPR if your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on your consent (Art. 6 para. 1 lit. a GDPR) and/or on our legitimate interests (Art. 6 para. 1 lit. f GDPR), as we have a legitimate interest in the effective processing of inquiries addressed to us.
The data you send to us via contact requests remains with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.
4.7. Reviews
If you use the "review" function within the R8 Services, in addition to your review, information about the time the review was created and, if you do not post anonymously, your chosen username will be displayed and stored.
The reviews and associated data (e.g., IP address) are stored and remain on this website until the commented content has been completely deleted or the reviews must be deleted for legal reasons (e.g., offensive comments).
The comments are stored on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can revoke consent you have given at any time. An informal notification by email to us is sufficient. The legality of data processing operations already carried out remains unaffected by the revocation.
5. PLUGINS, TOOLS & API
5.1. Google Web Fonts
This site uses so-called web fonts provided by Google for the uniform display of fonts. The Google Fonts are locally installed. A connection to Google servers does not take place.

5.2. The Movie Database API
The R8 Services also use The Movie Database API ("TMDB") operated by TiVo Platform Technologies, LLC. This enables us to show you movies and series and allows you to recommend these movies and series to friends. This represents a legitimate interest on our part within the meaning of Art. 6 para. 1 lit. GDPR. Without The Movie Database API application, our mobile app is not functional.

5.3. EXPO Services
The R8 Services also use the services of EXPO (https://expo.dev/) to make the app available for the App Store and to offer push notifications for users. Terms of use: https://expo.dev/terms; Privacy policy: https://expo.dev/privacy.
5.4. Google reCAPTCHA
We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on this website. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
reCAPTCHA is intended to check whether data entry on this website (e.g., in a contact form) is done by a human or by an automated program. For this purpose, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis begins automatically as soon as the visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g., IP address, length of stay of the website visitor on the website, or mouse movements made by the user). The data collected during the analysis is forwarded to Google.
The reCAPTCHA analyses run completely in the background. Website visitors are not informed that an analysis is taking place.
Data storage and analysis is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and spam. If appropriate consent has been requested (e.g., consent to store cookies), processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR; consent can be revoked at any time.

5.5. Registration or Login with Facebook Connect
There is the possibility to register using the social plugin "Facebook Connect" of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA ("Facebook"), within the framework of so-called single sign-on technology, if you have a Facebook profile. You can recognize the social plugins of "Facebook Connect" on our website by the blue button with the Facebook logo and the inscription "Log in with Facebook".
When Facebook Connect is used, your browser establishes a direct connection to Facebook's servers. The content of the plugin is transmitted by Facebook directly to your browser and integrated into the page. Through this integration, Facebook receives the information that your browser has accessed the corresponding page of our web presence, even if you do not have a Facebook profile or are not currently logged into Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there. These data processing operations are carried out in accordance with Art. 6 para. 1 lit. f GDPR on the basis of Facebook's legitimate interest in displaying personalized advertising based on browsing behavior.
By using this "Facebook Connect" button on our website, you also have the option to log in or register for the R8 Services using your Facebook user data. Only if you give your express consent in accordance with Art. 6 para. 1 lit. a GDPR before the registration process based on a corresponding notice about the exchange of data with Facebook, will we receive from Facebook when using the "Facebook Connect" button, depending on your personally made privacy settings on Facebook, the general and publicly accessible information stored in your profile. This information includes the user ID, name, profile picture, age, and gender.
We point out that after changes to Facebook's privacy policy and terms of use, when consent is granted, a transfer of your profile pictures, the user IDs of your friends, and the friends list may also occur if these have been marked as "public" in your privacy settings on Facebook. The data transmitted by Facebook is stored and processed by us to create a user account with the necessary data if you have authorized this on Facebook (salutation, first name, last name, address data, country, email address, date of birth). Conversely, based on your consent, data (e.g., information about your browsing behavior) can be transferred from us to your Facebook profile.

If you do not want Facebook to directly associate the data collected via our website with your Facebook profile, you must log out of Facebook before visiting our website. You can also completely prevent the loading of Facebook plugins with add-ons for your browser, e.g., with "Adblock Plus" (https://adblockplus.org/en/).
5.6. Registration or Login with Google
We also offer you the option to register for the R8 Services with the login data of your Google account at Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). For this purpose, you will be redirected to Google. Google requests certain permissions there so that you can log in with your Google login data. This links your Google profile with the R8 Services. Through the link, we see your data provided on Google (first and last name, email address, and a profile picture). The legal basis for processing is Art. 6 para. 1 lit. a GDPR.

If you do not wish this, we ask you to refrain from registering or logging in via your Google account. You can prevent further processing of your above-mentioned data stored in your Google account by us if you call up the option "Manage third-party access" in your Google account under "Security" and then under "Third-party apps with account access" and remove the access rights of the R8 Services.
5.7. Registration or Login with Apple
R8 also offers you the option to register or log in with the login data of your Apple account at Apple Inc. One Apple Park Way, Cupertino, California, USA, 95014 ("Apple"). The legal basis for processing data from Apple is Art. 6 para. 1 lit. a GDPR. 6. INFORMATION PURSUANT TO § 7 PARAGRAPH 3 UWG
After registration, we inform you about similar content and functions, for example about updates to your watchlist or movie collection or about movie and series recommendations from your friends. You can object to this use of your email address at any time without incurring any costs other than transmission costs according to basic rates. Please send your objection to hello@r8app.com. This notice is made in accordance with § 7 para. 3 UWG.
7. NEWSLETTER
If you would like to subscribe to a newsletter offered by the R8 Services, we need an email address from you as well as information that allows us to verify that you are the owner of the specified email address and agree to receive the newsletter. Further data is not collected or is collected only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.
The processing of data entered into the newsletter registration form is carried out exclusively on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can revoke consent you have given to the storage of data, the email address, and its use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter. The legality of data processing operations already carried out remains unaffected by the revocation.
The data you have stored with us for the purpose of subscribing to the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data stored with us for other purposes remains unaffected.
After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR).
